This volume examines how European institutions, the European Union in particular through its policy of conditionality, have shaped the post-conflict reconstruction of the Western Balkans. From state-building to democratization and environmental policies, this book explores whether and in what ways the EU has been successful in consolidating states and democracy in the Balkans. In addition to requiring countries to be ready to join the European Union, the EU has also set new conditions in an effort to become the prime international organization involved in stabilizing the Western Balkans after the wars of the 1990s. Its record has been mixed: the conditions of the EU have often been haphazard and were frequently not followed through. In addition, enlargement towards the Western Balkans has been slow and marred by open questions over the stability of some countries in the region. This volume assesses the EU's struggle to transform the societies through conditionality and whether the offer of EU membership is enough to build stable democracies. This book critically examines the process of statebuilding by the EU, focusing on its attempts to build Member States in the Western Balkan region. This book analyses the European Union's policies towards, and the impact they have, upon the states of the Western Balkans, and assesses how these affect the nature of EU foreign policy. To this end, it focuses on the tools and mechanisms that the EU employs in its enlargement policy and examines the new instruments of direct intervention (in Bosnia and Kosovo), political coercion (in the case of Croatia and Serbia in relation to the International Criminal Tribunal for the former Yugoslavia), and stricter conditionality in the Western Balkan countries. The book discusses the key aim of this special form of statebuilding, which is to establish functional liberal-democratic states in Albania, Bosnia and Herzegovina, Croatia, Kosovo, Macedonia, Montenegro, and Serbia in order for them to join the EU and to cope with the responsibilities and pressures of membership in the future. However, the authors argue that while the EU sees itself as an international actor that promotes and protects liberal-democratic values, norms and principles, its experiences in the Western Balkans demonstrate how the EU ́s actions in the region have undermined the basic principles of democratic decision-making (such as the European support for impositions in Bosnia) and international law (Kosovo), and have consequently contributed to new tensions (see police reform in Bosnia, and the tensions between Kosovo and Serbia) and dependencies. The European Union has come a long way in the Western Balkans in just a few years. Where, in the 1990s, the EU stood by and watched the Balkans burn, it was the US, within NATO, that acted decisively to stop the wars. In the aftermath of the Kosovo crisis, the Union finally found its voice to say no to new armed conflict in the heart of Europe. As part of the international presence in the region, the EU adopted sanctions, brokered political agreements, launched its first-ever police and military missions and directed economic, legal and administrative reforms to eradicate the roots of instability. Yet, despite the comprehensive nature of the Union’s actions, its strategies have been marked by confusion, its actions by concurrent or competing mandates of other international organisations. As the Western Balkans still contain the possibility of a genuine security threat, there is a real imperative to move the region as a whole from the stage of international protectorates and weak states to the stage of accession to the euro-Atlantic organisations to which they aspire. This book contains collection of articles which provide policy implications related to the problem of achieving substantive reform on the basis of harmonising legislation in Western Balkan (WB) countries with the standards of the European Union (EU). While WB states have generally been successful in adopting legal reforms that make up a part of EU conditionality, many laws remain unenforced, amounting to "empty shells." In the space between law, as it is written, and practices as they are engaged in everyday life, exists a gap, characterized by informality, clientelism, and exchange often based on strong tie relationships. Some instances of informality undermine the goal of establishing rule law and contribute to corruption. Others offer valuable solutions to persistent social problems or represent traditional vehicles of social cohesion that should be promoted. The recommendations in this book seek to address both constructive and damaging instances of informality, and to identify policy measures that can help to harmonise not only legislation, but existing informal practices on the ground.
