Critical theory and sociological theory

Critical theory and sociological theory PDF Author: Darrow Schecter
Publisher: Manchester University Press
ISBN: 1526105861
Category : Philosophy
Languages : en
Pages : 366

Book Description
Democracy in the twenty-first century faces a number of major challenges, populism, neoliberalism and globalisation being three of the most prominent. This book examines such challenges by investigating how the conditions of democratic statehood have been altered at several key historical intervals since 1945. It demonstrates that the formal mechanisms of democratic statehood, such as elections, have always been complemented by civic, cultural, educational, socio-economic and constitutional institutions that mediate between citizens and state authority. Rearticulating critical theory with a contemporary focus, the book shows why a sociological approach is urgently needed to address conceptual deficits and explain how the formal mechanisms of democratic statehood need to be complemented and updated in new ways today.

Enforcing Corporate Social Responsibility Codes

Enforcing Corporate Social Responsibility Codes PDF Author: Anna Beckers
Publisher: Bloomsbury Publishing
ISBN: 1849469008
Category : Law
Languages : en
Pages : 755

Book Description
Corporate social responsibility codes are guidelines that companies voluntarily develop and publish with the objective of showing the public their commitment to respect human rights, to improve fundamental workplace standards worldwide and to protect the natural environment. These corporate codes have become a crucial element in the regulatory architecture for globally operating companies. By focusing on the characteristics of the codes, their effects on society and their legal consequences, this book seeks to provide a comprehensive analysis of corporate codes and the law. Enforcing Corporate Social Responsibility Codes develops proposals on the relationship between global corporate self-regulation and the national private law systems. It uses methods of comparative law and sociological jurisprudence to argue that national private law can, and in fact should, enforce these codes as genuine legal obligations. The author formulates legal policy recommendations for English and German private law that indicate how the proposed legal enforcement could be realised in practice. The dissertation on which this book is based was awarded the second prize in the humanities category of the Deutscher Studienpreis (German Thesis Award) by the Koerber Foundation in November 2015.

The Financial Crisis in Constitutional Perspective

The Financial Crisis in Constitutional Perspective PDF Author: Poul F Kjaer
Publisher: Bloomsbury Publishing
ISBN: 1847318223
Category : Law
Languages : en
Pages : 431

Book Description
This volume presents the first thorough sociologically-informed legal analysis of the financial crisis which unfolded in 2008. It combines a multitude of theoretically informed analyses of the causes, dynamics and reactions to the crisis and contextualises these within the general structural transformations characterising contemporary society. It furthermore explores the constitutional implications of the crisis and suggests concrete changes to the constitutional set-up of contemporary society. Although the question of individual responsibility is of crucial importance, the central idea animating the volume is that the crisis cannot be reduced to a mere failure of risk perception and management for which individual and collective actors within and outside of financial organisations are responsible. The 2008 crisis should rather be understood as a symptom of far deeper structural transformations. For example contemporary society is characterised by massive accelerations in the speed with which societal processes are reproduced as well as radical expansions in the level of globalisation. These transformations have, however, been asymmetrical in nature insofar as the economic system has outpaced its legal and political counterparts. The future capability of legal and political systems to influence economic reproduction processes is therefore conditioned by equally radical transformations of their respective operational forms and self-understanding. Potentially the 2008 crisis, therefore, has far-reaching constitutional implications.

Sociology of Constitutions

Sociology of Constitutions PDF Author: Alberto Febbrajo
Publisher: Routledge
ISBN: 1317052927
Category : Law
Languages : en
Pages : 476

Book Description
This collection brings together some of the most influential sociologists of law to confront the challenges of current transnational constitutionalism. It shows the constitution appearing in a new light: no longer as an essential factor of unity and stabilisation but as a potential defence of pluralism and innovation. The first part of the book is devoted to the analysis of the concept of constitution, highlighting the elements that can contribute from a socio-legal perspective, to clarifying the principle meanings attributed to the constitution. The study goes on to analyse some concrete aspects of the functioning of constitutions in contemporary society. In applying Luhmann’s General Systems Theory to a comparative analysis of the concept of constitution, the work contributes to a better understanding of this traditional concept in both its institutionalised and functional aspects. Defining the constitution’s contents and functions both at the conceptual level and by taking empirical issues of particular comparative interest into account, this study will be of importance to scholars and students of sociology of law, sociology of politics and comparative public law.

Book Description
As many disciplines in the humanities have experienced a focus on culture’s impact in recent decades, questions surrounding the significance of media such as writing, print and computer networks have become increasingly relevant. From Globalization to World Society

From Globalization to World Society PDF Author: Boris Holzer
Publisher: Routledge
ISBN: 1317679997
Category : Social Science
Languages : en
Pages : 366

Book Description
Since the 1970s, various sociological approaches have tried to understand and conceptualize "the global," yet few of them have systematically addressed the full spectrum of social relationships. Prominent exponents of the global approach - such as world systems analysis - instead have focused on particular domains such as politics or the economy. Under the label of "world society," however, some authors have suggested alternatives to the predominant equivocation of society and the nation-state. The contributions to this volume share that objective and take their point of departure from the two most ambitious projects of a theory of world society: world polity research and systems theory, mapping out the common ground and assessing their potential to inform empirical analyses of globalization.
