The Market Or the Public Domain

The Market Or the Public Domain PDF Author: Daniel Drache
Publisher: Routledge
ISBN: 1134576773
Category : Business & Economics

Pages : 409

Book Description
Examining the powerful idea of the return, reconstitution and redeployment of the public domain in a post-Seattle and post-Washington consensus world order, this innovative book is the most forward-looking and comprehensive examination of the need to rethink the tenants of global free trade. In the past two decades, countries have focused on broadening and guaranteeing market access, and as the pendulum swings back for the market, the issue of investing in the public domain becomes a priority. The authors believe that devising new institutions of governance for a globalizing world requires fundamental change nationally and internationally. They argue that new public spaces, places and services are required to strengthen democracy and create sanctuaries in society where the market mechanism cannot reach. The public domain is an incipient concept that enables states to reduce the intrusiveness of markets and at the same time develop a strong national performance to reduce the inequality and social exclusion in an increasingly volatile global economy. This original volume boasts an impressive list of international contributors who have demonstrated innovation and leadership in their fields. It will strongly appeal to advanced students, academics and policy makers involved in the field of global governance and international political economy.

Book Description
The presence of a robust public domain is an essential precondition for cultural, social and economic development and for a healthy democratic process. But the public domain is under pressure as a result of the ongoing march towards an information economy. Items of information, which in the `old economy had little or no economic value, such as factual data, personal data, genetic information and pure ideas, have acquired independent economic value in the current information age, and consequently become the object of property rights making the information a tradable commodity. How and to what extent does the commodification of information affect the free flow of information and the integrity of the public domain? Does the freedom of expression and information, guaranteed inter alia in the European Convention on Human Rights, call for active state intervention to `save the public domain? What means both legal and practical are available or might be conceived to guarantee and foster a robust public domain? These were the main questions that were addressed in a major collaborative research project led by the Institute for Information Law of the University of Amsterdam (IViR) in co-operation with the Tilburg Institute for Law, Technology and Society (TILT) of Tilburg University, and funded by ITeR, the Dutch National Program for Information Technology and Law. Thirteen contributions from academia worldwide make up the present book, addressing the future of the public domain from a different angle. In addition, all authors were invited to reflect upon the notion and role of the public domain in the context of information law and policy. Should this concept be limited to that of a `negative image of (intellectual) property protection, i.e. all publicly available information not subject to a property right, and therefore freely (i.e. gratis) available, or should a broader approach be taken, e.g. all information available from public sources at affordable cost? Should information policies be aimed at maximizing the public domain or optimizing information flows? To what extent are these aims congruent? This book takes a broader, `information law oriented approach towards the question of preserving the public domain, in which a wide range of interrelated legal questions converge. Issues treated in this book include: Economic analysis of the public domain Fundamental rights analysis of the public domain Impact of the application of technological protection measures and contractual restrictions on the public domain The impact of the expansion of copyright, database right and patent rights on the public domain The impact of the commodification of private data, government information, indigenous knowledge on the public domain The capacity of the Open Source and Creative Commons Movements to preserve the integrity of the public domain The Future of the Public Domain is an important work for all those interested or involved in the regulation of the knowledge economy. Legal scholars, academic and research institutions, corporate counsel, lawyers, government policymakers and regulators all these and more will benefit enormously from the thoughtful and incisive discussions presented here.

Abraham Drassinower presents a new way to balance the needs of creators and users of authored works. The Birth of Doubt

The Birth of Doubt PDF Author: Moshe Halbertal
Publisher: SBL Press
ISBN: 1951498771
Category : Religion
Languages : en
Pages : 250

Book Description
A systematic attempt to understand the rabbinic world through its approach to confronting uncertainty In the history of halakhah, the treatment of uncertainty became one of the most complex fields of intense study. In his latest book, Moshe Halbertal focuses on examining the point of origin of the study of uncertainty in early rabbinic literature, including the Mishnah, Tosefta, and halakhic midrashim. Halbertal explores instructions concerning how to behave in situations of uncertainty ranging from matters of ritual purity, to lineage and marriage, to monetary law, and to the laws of forbidden foods. This examination of the rules of uncertainty introduced in early rabbinic literature reveals that these rules were not aimed at avoiding but rather at dwelling in the midst of uncertainty, thus rejecting the sectarian isolationism that sought to minimize a community’s experience of and friction with uncertainty. Features: A thorough investigation of the principles concerning how to behave in cases of uncertainty An examination of two distinct modes for coping with uncertainty

Insurgencies and Revolutions

Insurgencies and Revolutions PDF Author: Haripriya Rangan
Publisher: Taylor & Francis
ISBN: 1134824270
Category : Architecture
Languages : en
Pages : 308

Book Description
Over the past six or more decades, John Friedmann has been an insurgent force in the field of urban and regional planning, transforming it from its traditional state-centered concern for establishing social and spatial order into a radical domain of collaborative action between state and civil society for creating ‘the good society’ in the present and future. By opening it up to theoretical engagement with a wide range of disciplines, Friedmann’s contributions have revolutionised planning as a transdisciplinary space of critical thinking, social learning, and reflective practice. Insurgencies and Revolutions brings together former students, close research associates, and colleagues of John Friedmann to reflect on his contributions to planning theory and practice. The volume is organized around five broad themes where Friedmann’s contributions have risen to challenge established paradigms and generated the space for revolutionary thinking and action in urban and regional planning – Theorising hope; Economic development and regionalism; World cities and the Good city; Social learning, empowered communities, and citizenship; and Chinese cities. The essays by the authors reflect their engagement with his ideas and the new directions in which they have taken these in their work in planning theory and practice.
