The Netherlands, Belgium and Luxembourg are well-known cases of consensus politics. Decision-making in the Low Countries has been characterized by broad involvement, power sharing and making compromises. These countries were also founding member states of the European Union (EU) and its predecessors. However, the relationship between European integration and the tradition of domestic consensus politics remains unclear. In order to explore this relationship this book offers in-depth studies of a wide variety of political actors such as governments, parliaments, political parties, courts, ministries and interest groups as well as key policy issues such as the ratification of EU treaties and migration policy. The authors focus not only on Europeanization, but also analyse whether European integration may gradually undermine the fundamental characteristics of consensus politics in the Low Countries. Drawing on consociationalism and Europeanization research, this volume provides a comprehensive overview of Europeanization in these three EU member states as well as a better understanding of the varieties of consensus politics across and within these countries. The book examines how such questions can be resolved within the framework of the European Convention of Human Rights. 'European consensus' is a tool of interpretation used by the European Court of Human Rights as a means to identify evolution in the laws and practices of national legal systems when addressing morally sensitive or politically controversial human rights questions. If European consensus exists, the Court can establish new human rights standards that will be binding across European states. Democratic theory considers it fundamental for parties in government to be both responsive to their electorate and responsible to internal and international constraints. But recently these two roles have become more and more incompatible with Mair’s growing divide in European party systems between parties which claim to represent, but don’t deliver, and those which deliver, but are no longer seen to represent truer than ever. This book contains a qualitative and quantitative analysis of the behaviour of the opposition parties in eleven European democracies across Western and East Central Europe. Specifically, it investigates the parliamentary behaviour of the opposition parties, and shows that the party context is increasingly diverse. It demonstrates the emergence of two distinct types of opposition: one more cooperative, carried out by the mainstream parties (those with government aspirations), and one more adversarial focusing on government scrutiny rather than on policy alternatives (parties permanently excluded from power). It systematically and analytically explores the sources of their behaviour, whilst acknowledging that opposition is broader than its mere parliamentary behaviour. Finally, it considers the European agenda and the economic crisis as two possible intervening variables that might have an impact on the opposition parties’ behaviour and the government-opposition relations. As such, it responds to questions that are major concerns for the European democracies of the new millennium. This book examines the legal nature of Islamic states and the human rights they have committed to uphold. It begins with an overview of the political history of Islam, and of Islamic law, focusing primarily on key developments of the first two centuries of Islam. Building on this foundation, the book presents the first study into Islamic constitutions to map the relationship between Sharia and the state in terms of institutions of governance. It then assesses the place of Islamic law in the national legal order of all of today's Islamic states, before proceeding to a comprehensive analysis of those states' adherences to the UN human rights treaties, and finally, a set of international human rights declarations made jointly by Islamic states. Throughout, the focus remains on human rights. Having examined Islamic law first in isolation, then as it reflects into state structures and national constitutional orders, the book provides the background necessary to understand how an Islamic state's treaty commitments reflect into national law. In this endeavour, the book unites three strands of analysis: the compatibility of Sharia with the human rights enunciated in UN treaties; the patterns of adherence of Islamic states with those treaties; and the compatibility of international Islamic human rights declarations with UN standards. By exploring the international human rights commitments of all Islamic states within a single analytical framework, this book will appeal to international human rights and constitutional scholars with an interest in Islamic law and states.
