Criminal Justice, Restitution, and Reconciliation

Criminal Justice, Restitution, and Reconciliation PDF Author: Burt Galaway
Publisher:
ISBN:
Category : Law
Languages : en
Pages : 252

Book Description
Through the 1970s and 1980s interest in restitution has grown, with the practice moving from a few special projects to much broader application as a part of pretrial diversion, probation, and mediation programs that operate as an alternative to criminal or juvenile justice processing of cases. But, as the papers in this volume reflect, the interest in restitution has moved considerably beyond the idea of offenders repaying victims. A theory of restorative justice is emerging.

Rights for Victims of Crime

Rights for Victims of Crime PDF Author: Irvin Waller
Publisher: Rowman & Littlefield Publishers
ISBN: 1442207078
Category : Social Science
Languages : en
Pages : 234

Book Description
When the victims of injustice lose faith in their justice system, the crime they've endured cuts only deeper, adding insult to injury. The time has come to face the truth that most victims of crime will not have their needs met and often won't experience our systems of justice as just. This short book makes its readers experts in advocating rights for victims of crime. It empowers taxpayers, voters and (potential) victims of crime to make the case to rebalance justice and support victims. Written for the millions of victims of crime and their friends and families, it helps to transform an antiquated system of criminal and civil justice into a modern system that is just and fair, shifting from neglect to respect and support. While some laws in the USA and elsewhere do support victims by providing assistance, compensation, and protection from the accused, this book also sheds a harsh light upon their inadequate implementation. Police services must catch crooks but make victims their client. Courts must balance rights for defendants and victims. Services for women, children and elderly victims must be adequately funded. Restitution from offenders must be ordered and collected, not overlooked. Fair compensation from the state must change from a secret to a given. The prevention of victimization must be the budget priority not mass incarceration. Despite the speeches and the United Nations norms, governments still leave most victims of crime without basic information, support, and assistance, let alone respect and remedies in courts. If you are not yet one of those victims of crime, social responsibility requires you to ensure that your country's systems of justice are fair to those who are and for them, this book provides an answer.

Holocaust Justice

Holocaust Justice PDF Author: Michael J. Bazyler
Publisher: NYU Press
ISBN: 0814799043
Category : History
Languages : en
Pages : 431

Book Description
"The unique features of the American system of justice - which allowed it to handle claims that originated over fifty years ago and in another part of the world - made it the only forum in the world where Holocaust claims could be heard. Without the lawsuits brought by American lawyers. Bazyler asserts, the claims of the elderly survivors and their heirs would continue to be ignored."--BOOK JACKET.

Restorative Justice on Trial

Restorative Justice on Trial PDF Author: H. Messmer
Publisher: Springer Science & Business Media
ISBN: 9401580642
Category : Social Science
Languages : en
Pages : 575

Book Description
Victim-offender mediation schemes have experienced significant growth in the last decade. They are seen as an important and innovative alternative to the traditional sanctions of the criminal justice system. After a critical look at mediation schemes in the United States and Canada, most European countries have also increased their efforts to develop informal strategies to deal with deviant behavior. In terms of their legal and organizational base, it turns out that type, extent, and capacities for development are quite different in the individual countries -resulting in a remarkable diversity of programs with different outcomes. The contributions in this book are revised and edited versions of papers presented at the NATO Advanced Research Workshop Conflict, Crime and Reconciliation: The Organization of Welfare Intervention in the Field of Restitutive Justice in April 1991 at Il Ciocco, Italy. The chapters document the present stage of restorative justice in the individual countries, critically assess legal constraints and public needs, discuss the organizational requirements of implementation, and also evaluate outcomes in a broader context of crime and social policy. In the long run, this book should encourage further debates in the field of restorative justice and help build valid guidelines for an international evaluation research.
