Book Description
Excerpt from A Popular Treatise on the Law of Marriage and Divorce To those who have patronized these divorce sharks, and to those who may be tempted so to do, this little book is dedicated. A careful peru sal of its contents may enable them to protect themselves against fraud, and possibly save some of them from the penitentiary. There is but one road over which one must travel to undo a marriage, and this is through the channels of the local courts, where one, at least, of the parties permanently resides and has his or her domicile. A divorce obtained otherwise, though red-taped, red-lined, and bearing a golden seal, is but as waste paper, and no protection whatever at any time or place. A Treatise on the Law of Husband and Wife (Classic Reprint) PDF Author: James Schouler
Publisher: Forgotten Books
ISBN: 9781391629735

Pages : 730

Book Description
Excerpt from A Treatise on the Law of Husband and Wife The ground-work of the present volume on the law of Husband and Wife will be found in a treatise of some three hundred pages which the author's earlier work on the Domestic Relations contains. But when that treatise was written, the Married Women's Acts in England and America were a sort of first experiment or agitation; and since the second edition of the Domestic Relations not less than three thousand points have been decided, all tending to establish a mod ern jurisprudence concerning married women's rights, which decisions the author has examined while pre paring the present work, in addition to earlier author ities and various local codes. He has consequently expanded his subject, re-arranged his plan, and revised and re-written every topic, and the present work will be found essentially a new one, so far as relates espe cially to Promises to Marry, the Wife's Separate Pr0p erty under Equity and Recent Statutes, Transactions between Husband and Wife, Various Matters of Prac tice, and Separation and Divorce. A summary of the late Married Women's Acts in England and the United States will be found in the Appendix. No one can gain an intelligent comprehension of the rights and disabilities of the marriage union, as they exist to-day, without examining in order, (1) the old common-law or coverture doctrine; (2) the modifica tion of that doctrine by equity and recent legislation; (3) the latest local statute (judicially construed or not) which bears upon the particular point. To facilitate such an examination in due historical sequence is the main object of; the present work. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from A History of Divorce So far as I am aware, there is no book in the English language which gives a concise and simple account of the history of divorce, and there is no modem problem in which the historical and comparative study of law and opinion is so essential for those who administer or make the laws, and all those who wish to have an adequate knowledge of the subject in its modem bearings. The extraordinary diversity of laws and opinions which exists in modem countries of the same degree of civilisation, often professing the same religion, when seen in the light of history is found to have certain common elements which show that substantially the same forces have been at work in their evolution. The object of this book is to explain, as briefly and simply as I can, how this diversity came about, to endeavour to deduce from the facts of history the tendencies of thought and legislation, and to ascertain the principles which, according to the teaching of history, ought to be applied to modern legislation on the subject. Marriage and Divorce Laws of the World (Classic Reprint) PDF Author: Hyacinthe Ringrose

Pages : 282

Book Description
Excerpt from Marriage and Divorce Laws of the World The purpose of this volume is to furnish to the lawyer, legislator, sociologist and student a working summary of the marriage and divorce laws of the principal countries of the world. There are no geographical boundaries to virtue, wisdom and justice, and no country has as yet monopolized all that is best in creation. The mightiest of the nations lacks something which is possessed by the weakest; and there is no branch of comparative jurisprudence of more general con sequence than that treating of marriage, which is the keystone of civilization. By civilization we do not mean community life according to the standard of a single individual or nation, but in its broader and better sense, meaning the civil organization of any large group of human beings.
