This edited volume examines the multifaceted impact of the COVID-19 pandemic on peoples and states in East Asia. The book brings together selected case studies in Southeast Asia and the wider East Asian region that analyse how states in the region have responded to the pandemic and its multi-dimensional threats to human security, including risks of atrocity crimes. In the context of protecting human security and upholding the Responsibility to Protect (R2P), the work analyses how such a consequential crisis has compounded socio-economic and political problems, exacerbated societal fault lines, and created new types of risks for people's safety and security. Using the United Nations Framework of Analysis for Atrocity Crimes: A Tool for Prevention, the book presents seven case studies that identify relevant risks factors confronting selected countries and the extent to which the global pandemic has magnified and/or exacerbated such risks for affected populations. It draws key lessons on how states should manage extant and emerging risks for atrocity crimes and how they can build and enhance their capabilities for preventing atrocities in both conflict-affected and relatively stable states, particularly within the context of Pillar 1 (prevention) and Pillar 2 (capacity building) of the R2P principle. This book offers a novel and contemporary examination of the ‘responsibility to protect’ (R2P) doctrine from an international legal perspective and analyses how the doctrine was applied within the Libyan and Syrian conflicts as two recent and highly significant R2P cases. The book dissects each of R2P’s three component pillars to examine their international legal underpinnings, drawing upon diverse legal frameworks – including the laws of the UN, laws of international organisations, human rights law, humanitarian law, criminal law, environmental law, and laws of State responsibility – to extract conclusions regarding existing and emerging host and third-State obligations to prevent and react to mass atrocity crimes. Paramilitary or irregular units have been involved in practically every case of identity-based mass violence in the modern world, but detailed analysis of these dynamics is rare. Exploring the case of former Yugoslavia, the genocides in Rwanda and Darfur, and the ongoing violence in Syria, Kate Ferguson exposes the relationships between paramilitaries, state commands, local communities, and organized crime. She presents these 'architectures of violence' as a way of comprehending how the various structures of command and control fit together into domestic and international webs of support enabling and encouraging irregular and paramilitary violence. Visible paramilitary participation in modern mass atrocities has succeeded in masking the continued dominance of the state in a number of violent crises. Irregular combatants have participated so significantly in committing atrocity crimes because political elites benefit from using unconventional forces to fulfil ambitions that violate international law--and international policy responses are hindered when responsibility for violence is ambiguous. Ferguson's inquiry into these overlooked dynamics of mass violence unveils substantial loopholes in current atrocity prevention architecture. Until these are addressed, state authorities will likely continue to use irregular combatants as perpetrators of atrocity.

This book provides a systematic analysis of reform measures aimed at strengthening the implementation of the ‘Responsibility to Protect’ (R2P) doctrine, utilising a cosmopolitan lens. In 2005, member states of the United Nations (UN) accepted a ‘Responsibility to Protect’ against four mass atrocity crimes: genocide, crimes against humanity, war crimes, and ethnic cleansing. Despite this commitment, mass atrocities remain a pervasive aspect of the international landscape. In addressing R2P reform, the book utilises a ‘transitional cosmopolitan’ lens. The aim of this transitional cosmopolitan approach is to promote incremental progress towards solving moral problems by operating within particular contexts and practical barriers to change. Three areas for reform are explored: the UN Security Council P5’s power of veto, to prevent the veto obstructing timely and decisive R2P response action; the powers of the UN General Assembly as an alternative means for responding to mass atrocity situations; and the establishment of an ‘R2P Commission’ to hold states accountable for their R2P commitments. These are not advocated as the definitive areas for R2P reform. However, each of the recommendations made can contribute at least some positive progress towards a more cosmopolitan application of the R2P that would help in curbing mass atrocity and improving the protection of fundamental human rights. This book will be of much interest to students of the Responsibility to Protect, genocide, humanitarian protection, and International Relations in general.
