Aquaculture, the farming in water of aquatic animals and aquatic plants, has seen extraordinary growth over recent years in terms of production levels and as regards its share of production of aquatic animals and algae. Although the most recent figures show a slight slowdown in the rate of growth of the sector (FAO, 2022), aquaculture is still seen to have tremendous potential. Many developing countries have high aspirations for rapid aquaculture development in order to feed their fast-growing populations and to increase export earnings. The aim of this study is to identify the essential elements of a legal framework for sustainable aquaculture. For the fact is that in many countries the growth of aquaculture appears to have outpaced the development of the legislation and legal frameworks to govern aquaculture. This study is intended both to act as a guide to the complexity of legal frameworks for aquaculture and also to serve as the background or resource document for the Aquaculture Legal Assessment and Revision Tool (ALART).

While the aquaculture sector has seen extraordinary global growth over recent years, it also faces a number of important challenges. Although aquaculture may reduce pressure on wild fish stocks, the fact remains that the sector can also have a range of negative environmental impacts. At the same time, a degraded environment, in particular poor water quality, can adversely affect the health of aquatic animals and plants used in aquaculture and therefore the economic sustainability of the sector. Moreover, if appropriate bio-security measures, in the sense of measures to protect aquatic animal health, aquatic plant health and human health, are not in place (or are not implemented), the sector can be subject to devastating disease outbreaks. It follows that the legal framework for aquaculture should support the development of the sector while at the same time promoting its long term environmental, social and economic sustainability. This requires a balancing act. Overly burdensome legislation may discourage or otherwise hinder investment. At the same time, insufficient regulation may encourage indiscriminate and substandard operations that lead to uncontrollable disease outbreaks, irreparable environmental damage and the economic failure of aquaculture operations with ensuing social costs. Unlike capture fishing, which is regulated largely if not exclusively on the basis of a fisheries law, the legal framework for aquaculture is invariably diverse and complex. Some aspects of aquaculture are addressed in legislation that has aquaculture as its specific or primary focus, such as a chapter in a fisheries law or a stand-alone aquaculture law (described in this document as ‘aquaculture legislation’).

This study considers the elements of a legal framework designed to promote a sustainable commercial aquaculture. These relate to: a secure right to property and clean water; avoidance of unnecessary costs; and a licence system, including a system for environmental impact assessments and enforcement of codes of practice. Environmental supervision should extend to: controls over the use of exotic species and products from modern biotechnology. These include genetically modified organisms, disease control and health management, and to any water quality concerns created by the proposed project. The study analyses the aquaculture industries of Madagascar, Malawi, Mozambique, Nigeria and Zambia against these criteria. Improvements in legislation applicable to the individual countries, but which require consideration by all sub-Saharan countries are then suggested.

The ecosystem approach to aquaculture provides the conceptual guideline to spatial planning and management. This publication describes the three major steps in spatial planning and management, namely, zoning, site selection and design of an aquaculture management area, or AMA. The rationale for and objectives of each step, the ways (methodologies) to implement it, and the means (tools) that are available to enable a methodology are described in a stepwise fashion. Recommendations to practitioner s and policy-makers are provided. A separate policy brief accompanies this paper. The benefits from spatial planning and management are numerous and include higher productivity and returns for investors, and more effective mitigation of environmental, economic and social risks, the details of which are provided in this paper. This publication is organized in two parts. Part one is the “Guidance”; it is the main body of the document and describes the processes and steps for spatial planning, incl uding aquaculture zoning, site selection and area management. Part two of the publication includes six annexes that present key topics, including: (i) binding and non-legally binding international instruments, which set the context for sustainable national aquaculture; (ii) biosecurity zoning; (iii) aquaculture certification and zonal management; (iv) an overview of key tools and models that can be used to facilitate and inform the spatial planning process; (v) case studies from ten countries – Brazil, Chile, China, Indonesia, Mexico, Oman, the Philippines, Turkey, Uganda and the United Kingdom of Great Britain and Northern Ireland; and (vi) a workshop report.
