The Expansion of the Common Law

The Expansion of the Common Law PDF Author: Sir Frederick Pollock
Publisher: Forgotten Books
ISBN: 9781330300121
Category : Law
Languages : en
Pages : 179

Book Description
Excerpt from The Expansion of the Common Law The lectures from which this volume is named were delivered to the Law Schools of several American Universities last autumn. A few additions have been made to the original text. The address given at the request of the Harvard Law School Association for its commemoration of 1895 was not intended at the time to have any sequel, but is now prefixed to the course of 1903 as being sufficiently germane to the matter to serve as a general introduction. Familiar matters of both fact and law were necessarily taken for granted in delivering the lectures; and it does not now seem desirable to vouch authorities at large for them. References have been given only where it is thought that they may be really useful for verification or farther search. Book Description
Excerpt from The Origin and Growth of the Common Law in England and America: A Study of Private Law, Comparing the Evolution of the Common Law and the Civil Law No one knows better than myself that this book is at best only an introduction, but a good introduction to law has a real place to fill. The authorities before each lecture are themselves only a selection, a selection which individual tastes would perhaps vary, but at least they will enable students to go further into the subjects discussed. Space compelled the. Limitation of cases to those in the Supreme Court. The Tables are useful, but necessarily brief and probably omit some. Men and events which others would think appropriate; they can be enlarged at will. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The Creation of American Common Law, 1850–1880

The Creation of American Common Law, 1850–1880 PDF Author: Howard Schweber
Publisher: Cambridge University Press
ISBN: 9781139449946
Category : Political Science
Languages : en
Pages : 314

Book Description
This book is a comparative study of the American legal development in the mid-nineteenth century. Focusing on Illinois and Virginia, supported by observations from six additional states, the book traces the crucial formative moment in the development of an American system of common law in northern and southern courts. The process of legal development, and the form the basic analytical categories of American law came to have, are explained as the products of different responses to the challenge of new industrial technologies, particularly railroads. The nature of those responses was dictated by the ideologies that accompanied the social, political, and economic orders of the two regions. American common law, ultimately, is found to express an emerging model of citizenship, appropriate to modern conditions. As a result, the process of legal development provides an illuminating perspective on the character of American political thought in a formative period of the nation.
