This book analyses the multifaceted ways law operates in the context of human mobility, as well as the ways in which human mobility affects law. Migration law is conventionally understood as a tool to regulate human movement across borders, and to define the rights and limits related to this movement. But drawing upon the emergence and development of the discipline of mobility studies, this book pushes the idea of migration law towards a more general concept of mobility that encompass the various processes, effects, and consequences of movement in a globalized world. In this respect, the book pursues a shift in perspective on how law is understood. This book advocates for the philosophical import of care in re-evaluating problems of humanitarianism in the context of the ongoing international refugee and forced migration situation. While the idea of total revolution seems anachronistic today, there is increasing consensus about the importance of new forms of political, ethical, and aesthetic resistance. In the past, resistance was often motivated as a form of protest against specific institutions. Increasingly, dissent has become integrated into the fabric of modern life. This volume addresses new forms of resistance at a level that combines a rootedness in the philosophical tradition and a sensitivity to rethinking the possibility of emancipation in today's age. This book provides a philosophical defence of open borders. Two policy dogmas are the right of sovereign states to restrict immigration and the infeasibility of opening borders. These dogmas persist in face of the human suffering caused by border controls and in spite of a global economy where the mobility of goods and capital is combined with severe restrictions on the movement of most of the world’s poor. Alex Sager argues that immigration restrictions violate human rights and sustain unjust global inequalities, and that we should reject these dogmas that deprive hundreds of millions of people of opportunities solely because of their place of birth. Opening borders would promote human freedom, foster economic prosperity, and mitigate global inequalities.
