This volume casts a fresh look on how the political spaces of the Western Balkan states (Croatia, Bosnia and Herzegovina, Serbia, Montenegro, Kosovo, Macedonia and Albania) are shaped, governed and transformed during the EU accession process. The contributors argue that EU conditionality in the Western Balkans does not work ‘effectively’ in terms of social change because rule transfer remains a ‘contested’ business, due to veto-players on the ground and strong legacies of the past. The volume examines specific policy areas, salient in the enlargement process and to a different degree incorporated in the accession criteria, as well as EU foreign policy in the spheres of post-conflict stabilisation, democratization and the rule of law promotion.

This volume examines how European institutions, the European Union in particular through its policy of conditionality, have shaped the post-conflict reconstruction of the Western Balkans. From state-building to democratization and environmental policies, this book explores whether and in what ways the EU has been successful in consolidating states and democracy in the Balkans. In addition to requiring countries to be ready to join the European Union, the EU has also set new conditions in an effort to become the prime international organization involved in stabilizing the Western Balkans after the wars of the 1990s. Its record has been mixed: the conditions of the EU have often been haphazard and were frequently not followed through. In addition, enlargement towards the Western Balkans has been slow and marred by open questions over the stability of some countries in the region. This book critically examines the process of statebuilding by the EU, focusing on its attempts to build Member States in the Western Balkan region. This book analyses the European Union's policies towards, and the impact they have, upon the states of the Western Balkans, and assesses how these affect the nature of EU foreign policy. To this end, it focuses on the tools and mechanisms that the EU employs in its enlargement policy and examines the new instruments of direct intervention (in Bosnia and Kosovo), political coercion (in the case of Croatia and Serbia in relation to the International Criminal Tribunal for the former Yugoslavia), and stricter conditionality in the Western Balkan countries. The book discusses the key aim of this special form of statebuilding, which is to establish functional liberal-democratic states in Albania, Bosnia and Herzegovina, Croatia, Kosovo, Macedonia, Montenegro, and Serbia in order for them to join the EU and to cope with the responsibilities and pressures of membership in the future. However, the authors argue that while the EU sees itself as an international actor that promotes and protects liberal-democratic values, norms and principles, its experiences in the Western Balkans demonstrate how the EU ́s actions in the region have undermined the basic principles of democratic decision-making (such as the European support for impositions in Bosnia) and international law (Kosovo), and have consequently contributed to new tensions (see police reform in Bosnia, and the tensions between Kosovo and Serbia) and dependencies. Do EU institutions have an influence on the implementation of the rule of law in potential candidate countries and, if so, of what kind? During the compliance monitoring process related to the effective rule of law and democracy the EU Commission tests and criticizes the effectiveness of the judiciary and strengthens the rule of law in preparation for accession. In the Western Balkans this was a process fraught with difficulties. Despite the fact that academic scholarship and democratic politics agree on rule of law as a legitimizing principle for the exercise of state authority, there is no uniform European standard for institution-building or monitoring activities by the EU in this area. With focus on the reform of the judiciary in five case study countries of Bosnia and Herzegovina, Kosovo, Macedonia, Montenegro, and Serbia, this empirical research investigates the EU's transformative power with regard to the effectiveness of rule of law and judicial sector reform in its infancy. It analyses the depth and limitations of EU rule of law promotion in the Western Balkans and presents policy recommendations intended to address the shortcomings in judiciary reform.
