Key messages Foreign investors are increasingly partnering with ASM operators to access mineral rights and reserves, in a high risk and high cost environment.This has led to an upgrading of ASM operations and indirect technology diffusion across mining areas through 'demonstration effects', but this upgrading may disrupt existing benefit sharing arrangements between ASM laborers and pit-owners/license holders.Upgrading of ASM, through capital infusion and technology advancement, is also accompanied by high environmental and occupational health and safety risks.The constrained capacity of sub-national institutions and lack of cross-institutional coordination are hampering governmental efforts to monitor and improve environmental and occupational health and safety practices of partnerships.Policy discussion is needed on the ASM-investor partnership model’s benefits and risks, and how best to harness its potential to upgrade the sector, as well as support the sustainable development of rural mining communities.Effective institutional coordination among key government institutions, particularly at sub-national level, is urgently needed to reduce the high environmental and labor safety risks posed by mechanized small-scale mines.

The International Development Law Organization (IDLO) and the Center for International Forestry Research (CIFOR) assessed the legal frameworks that govern land-use activities and investments in Tanzania. The policy, institutional and legal frameworks are well developed although implementation and enforcement remains weak due to ambiguities in the law and a general lack of supportive incentives. This Legal Assessment report for Tanzania examines four key challenges to the attainment of sustainable land-use investments. These comprise: Enforcement of environmental and social safeguards Tanzania has made progress in implementing the Environmental Management Act by ensuring greater compliance with the Environmental Impact Assessment regulations although exceptions exist in the construction sector, and mining legislation that often enables the government to circumvent important land tenure safeguards. Incentives for sustainable investments in the legal framework A lack of incentives exists despite the creation of the Tanzania Investment Centre, the adoption of an Investment Guide in 2013, and the incorporation of sustainability considerations into laws and policies governing investments in the agriculture, energy, and forestry and mining sectors. Land tenure security Tanzanias land law framework now includes formal recognition of customary title and the reservation of land under the category of village land exclusively for Tanzanians although improvements are still needed in terms of processes of consultation and compensation. Public awareness and lack of access to information Awareness of natural resources and investment policies, legislation and regulations is generally low amongst rural communities as well as Ward executive officers, village leaders and village land committee members. There are about four million peasant families in Tanzania. They farm on the smallest scale, the average farm being two acres in size. The principal agricultural equipment is the hand hoe. Since the onset of the colonial era, those in authority have pursued policies to dominate the peasantry. It is argued that the small scale of operations has contributed to the widespread poverty among farmers. There is still good agricultural land that is not farmed, but the current land tenure of peasants reproduces itself on new farmland. The conclusion is that in order to accelerate agricultural development, land tenure must be institutionalized.

The sustainable development of minerals, which are non-renewable resources, is a major challenge in today's world. In this regard the true definition of 'sustainability' is a debating point in itself: can such a concept exist with respect to non-renewable resources? Perhaps the ideal sustainability model is one that minimizes negative environmental impact and maximizes benefits to society, the economy and regional/national development. Developed and near-developed economies rely for commodity supplies on developing countries where major mining operations are often a mainstay of the domestic economy. Limited environmental regulation and low wages lead to charges of exploitation. Also, large numbers of people have no alternative to living by informal, often dangerous, 'artisanal' mining. This Special Publication gives examples from developing countries from all scales of mineral extraction. The volume reviews environmental, economic, health and social problems and highlights the need to solve these before sustainability can be achieved. The better solutions require mutual understanding, through full involvement of all stakeholders, education, training and investment so that small-scale and artisanal mines can grow into well-managed operations.
